ORDINANCE NO. 9760 AN ORDINANCE TO AMEND ORDINANCE NO. 8624, ENCAPTIONED, "AN ORDINANCE CLOSING AND ABANDONING EDITH DRIVE, LOCATED NORTHWEST OF JENKINS ROAD BETWEEN PINEWOOD DRIVE AND SHALLOWFORD ROAD, MORE PARTICULARLY DESCRIBED HEREIN, AND AS SHOWN ON PLAT ATTACHED HERETO AND MADE A PART HEREOF BY REFERENCE." SO AS TO CORRECT AN INADVERTENT ERROR IN THE LEGAL DESCRIPTION. _______________________ SECTION 1. WHEREAS, Ordinance No. 8624 contained an inadvertent error in the property description of the tract to be closed and abandoned; and WHEREAS, the staff of the Chattanooga-Hamilton County Regional Planning Commission recommends to the City Council of the City of Chattanooga that said error should be corrected; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHATTANOOGA, TENNESSEE, That Ordinance No. 8624, encaptioned as set forth above, be and is hereby amended to substitute the revised legal description as follows: Part of Edith Drive, a 40 foot wide unopened right-of-way beginning on the southwest line of Edith Drive 792 feet northwest of the intersection of the southwest line of Edith Drive with the northwest line of Jenkins Road, thence northwest 1392.6 feet, thence northeast 20 feet to the center line of Edith Drive, thence southeast 17.6 feet with said center line, thence northeast 20 feet to the northeast line of Edith Drive, thence southeast 1375 feet, thence southwest 40 feet to the southwest line of Edith Drive, the point of beginning. Said street separates lot 6-10 from lots 15-16 and part of 14, Noll's Acres Subdivision, as shown by plat of record in plat book 14, page 44, R.O.H.C. SECTION 2. BE IT FURTHER ORDAINED, That Ordinance No. 8624 shall remain in full force and effect except as set forth above. SECTION 3. BE IT FURTHER ORDAINED, That this Ordinance shall take effect two weeks from and after its passage, the public welfare requiring it.
